Broadcasting operation - approval

Service Description

As a private broadcaster, you need a license under state law. For broadcasts that are

  • are organized and broadcast in the local area of a public event and in temporal connection therewith, or
  • are offered for facilities, can only be received there and are functionally related to the tasks to be performed in these facilities

a simplified approval procedure is possible.

Broadcasts for a limited number of residential units or broadcasts in facilities that are limited to one building or a related complex of buildings do not require approval.
A license for nationwide broadcasting may be issued only to a natural person or legal entity that

  • has unlimited legal capacity
  • has not lost the capacity to hold public office through a judge's decision,
  • has not forfeited the fundamental right of freedom of expression under Article 18 of the Basic Law,
  • is not prohibited as an association
  • has its place of residence or registered office in the Federal Republic of Germany, another member state of the European Union or another state party to the Agreement on the European Economic Area and can be prosecuted in a court of law,
  • offers a guarantee that it will broadcast in compliance with the statutory provisions and the administrative acts issued on this basis.

Licenses may not be granted to legal entities under public law, with the exception of churches and universities, to their legal representatives and executive employees, or to political parties and voters' associations. The same shall apply to companies affiliated with the aforementioned under stock corporation law.
