Protection of minors

Service Description

The following regulations apply for the protection of children and young people:

Alcoholic beverages:

  • up to the age of 13:

    • Distribution (sale or serving) and consumption of alcoholic beverages are generally prohibited.

  • 14 and 15 years:

    Dispensing and consumption of beer, mixed drinks containing beer, sparkling wine, wine and mixed drinks containing wine are permitted if

  • a parent or a person with custody is present and

  • permits this.

  • 16 and 17 years:

    • Dispensing and consumption of beer, mixed drinks containing beer, sparkling wine, wine and mixed drinks containing wine are also permitted without supervision.

    • The sale and consumption of spirits and mixed drinks containing spirits remain prohibited.

  • from the age of 18:

    • The supply and consumption of spirits and mixed drinks containing spirits as well as all other alcoholic drinks are permitted without restrictions.

      Smoking:

  • under the age of 18

    • Children and young people are not allowed to smoke in public.

    • In addition, no tobacco products (such as cigarettes, electronic cigarettes, electronic shishas, cigarillos, tobacco, snuff) may be made available to them, i.e. they may not be sold.

    • Tobacco products and other nicotine-containing products and their containers may neither be offered to children and adolescents by mail order nor supplied by mail order.

    • Nicotine-free e-cigarettes and e-shishas are also subject to the ban on sale and consumption.

Media

  • under the age of 18

    • At public film events, children and young people may only watch films that are approved for their age.

      • "Released without age restriction"

      • "Released from the age of six"

      • "Released from the age of twelve"

      • "Released from the age of sixteen"

      • "Not rated for minors"

    • Image carriers that are not labeled or are labeled "Not rated for minors" may

      • not be offered, given or otherwise made available to a child or young person.

      • This also applies to off-premises retail and mail order sales.

  • under the age of 12

    • By way of derogation, children and young people aged 6 and over may also be permitted to attend films that are approved for children and young people aged 12 and over if they are accompanied by a person with parental authority.

  • Furthermore, attendance at public film events may only be permitted if accompanied by a person with parental authority or a person with parental responsibility

    • Children under the age of six,

    • children aged six and over if the screening ends after 8 p.m,

    • young people under the age of 16 if the performance ends after 10 p.m,

    • young people aged 16 and over if the screening ends after midnight.

Venues:
Restaurants / dance events, discotheques

  • Basic principle

    • The law does not regulate how long children and young people are generally allowed to stay out in the evening or whether they are allowed to spend the night with friends. This is decided by the parents.

    • Children and young people are generally prohibited from staying in night bars and amusement arcades.

Pubs and restaurants

  • up to the age of 15:

    • Children and young people under the age of 16 may only be allowed to stay in restaurants if they are accompanied by a person with parental authority or guardianship or if they have a meal or a drink between 5 am and 11 pm.

  • 16 and 17 years:

    • Young people aged 16 and over may not be permitted to stay in pubs or restaurants between midnight and 5 a.m. unless accompanied by a person with parental authority or a person with parental responsibility.

  • The above regulations do not apply if children or young people are taking part in an event organized by a recognized youth welfare organization or are on a trip.

  • from the age of 18:

The stay in restaurants is permitted without restrictions.

Dance events, discotheques

  • up to the age of 15:

    • Attendance at dance events and discos is only permitted if accompanied by a person with parental authority or guardianship.

  • By way of derogation, children may be present until 10 p.m. and young people under the age of 16 until midnight if the dance event is organized by a recognized youth welfare organization or serves artistic activities or the cultivation of customs.

  • 16 and 17 years:

    • Until midnight, attendance at dance events and discotheques is permitted unaccompanied by a person with parental authority or guardianship.

    • After midnight, attendance is only permitted when accompanied by a parent or guardian.

  • from the age of 18:

Attendance at dance events and in discotheques is permitted without restrictions.
