Persons may only carry out the activities specified in Section 42 (1) of the Infection Protection Act (IfSG) on a commercial basis for the first time and may only be employed in these activities for the first time if it is proven by a certificate issued by the public health department or by a physician appointed by the public health department, which is not more than three months old, that they have been
1. they have been instructed orally and in writing by the public health department or by a physician appointed by the public health department about the prohibitions of activities specified in Section 42, Paragraph 1, and about the obligations specified in Paragraphs 2, 4 and 5, and
2. have declared in writing, after having been instructed in accordance with number 1, that they are not aware of any facts that would justify a ban on their activities.
