The following activities, among others, are prohibited in the travel trade;

• Distribution of
  • poisons and goods containing poisons
    (exception: plant protection products, pesticides and wood preservatives for which a test certificate with a test mark has been issued in accordance with building regulations)
  • hernia bands, medical bandages, medical support apparatus and bandages, orthopaedic foot supports, spectacles and eyeglasses
    (exception: safety glasses and ready-to-wear reading glasses)
  • electromedical devices including electronic hearing aids
    • (exception: devices with direct exposure to heat)
    • securities, lottery tickets, subscription and share certificates for securities and lottery tickets
      (Exception: sale of lottery tickets as part of approved lotteries for charitable purposes on public ways, streets or squares or other public places)
    • Writings distributed with the promise of premiums or winnings
  • Offering and the purchase of
    • precious metals (gold, silver, platinum and platinum by-metals) and alloys containing precious metals in any form as well as goods with precious metal overlays
      (Exception: silver jewelry up to a selling price of 40.00 euros and goods with silver overlays)
    • precious stones, gemstones and synthetic stones as well as pearls
  • Offering alcoholic beverages
    (Exception: beer and wine in tightly closed containers, alcoholic beverages from self-produced products of viticulture, agriculture or orcharding and horticulture, the purchase of alcohol for the production of liqueurs and spirits from fruit, plants and other agricultural raw materials, where the raw materials are not fermented themselves, and alcoholic beverages served from a fixed place of business for consumption on the spot in the context of and for the duration of an event)
  • Conclusion and brokering of repurchase transactions (Section 34 (4) of the Trade Regulation Act) and brokering of loan transactions against payment for the borrower
  • Hawking of medicinal products and soliciting orders for medicinal products (Section 51 of the Medicinal Products Act).
    (Exceptions: Finished medicinal products released for circulation outside pharmacies, which are plants or parts of plants or pressed juices from fresh plants or parts of plants, designated by their customary German names, generally known in their effects, provided that they have not been prepared with any solvent other than water, or medicinal waters and their salts in their natural mixing ratio or their imitations.
    Insofar as the trader visits other persons in the course of their business, unless it is a question of medicinal products offered for sale for use on animals in agricultural and forestry enterprises, in commercial livestock farms and in vegetable, fruit, horticultural and viticultural enterprises, in beekeeping and in fishing, or if orders for medicinal products, the dispensing of which is reserved for pharmacies, are sought from these enterprises. This also applies to commercial travelers and other persons acting on behalf of and in the name of a trader).
  • Distribution and handing over of firearms, ammunition, cutting or impact weapons (§ 35 para. 3 sentence 1 No. 1 WaffG)
    (Exception: seeking out other persons in the course of their business)
  • Distribution and leaving explosive substances, as far as a travel trade license would be required or the requirements of § 55a para. 1 No. 1 or 3 of the Trade, Commerce and Industry Regulation Act are met (§ 22 para. 4 sentence 1 No. 1 Explosives Act).
    (Exception: distribution and transfer of pyrotechnic articles of category F1).

Exceptions are also possible by legal ordinance of the federal government or the state government. However, such legal ordinances do not currently exist.

You must apply for exceptions to the prohibitions in individual cases to the competent authority.
