Registration of a claim in insolvency proceedings by the KSK

Service Description

The Künstlersozialkasse (KSK) is an insolvency creditor. In the event of your insolvency, it registers claims with your insolvency administrator. The claims of the KSK are in particular

  • Contributions or artists' social security contributions,
  • late payment penalties,
  • reminder fees and
  • interest that you have not paid.

As soon as insolvency proceedings are opened, the KSK will cease its enforcement measures.

If you continue to work as a self-employed artist or journalist after insolvency proceedings have been opened, your obligation to take out insurance under the Artists' Social Insurance Act remains in force. You must continue to fulfill your insurance obligations. This includes, for example, contributions to the KSK for statutory health, long-term care and pension insurance for periods after the opening of insolvency proceedings. Payments for claims relating to the insolvency period may only be made in agreement with the KSK and from assets that cannot be seized.

If you continue your business subject to contributions after the opening of insolvency proceedings, your obligation to pay contributions under the Artists' Social Insurance Act remains in force. You must continue to fulfill your contribution obligations. This includes, for example, the artists' social security contribution to the KSK for periods after the opening of insolvency proceedings. The KSK may no longer accept payments for claims relating to the insolvency period.
