Chamber of Engineers - registration in the external register of the Chamber of Engineers of Thuringia (§ 14 ThürAIKG, § 64 ThürBO)

Service Description

According to the definition of Section 14 (1) of the Thuringian Chamber of Architects and Engineers Act of 14.12.2016 (ThürAIKG), non-resident service providers are natural persons who do not have their main residence, a professional branch or the place of their predominant professional activity in the Federal Republic of Germany and who move to Thuringia only for the temporary and occasional provision of services, such as those relating to the exercise of professional tasks of engineers and consulting engineers. The temporary and occasional character of the provision of legally protected services in connection with the exercise of professional tasks of a consulting engineer, engineer authorized to submit building documents, including the use of the protected professional titles "engineer" and "consulting engineer" is decisive.

As far as the foreign person proves the existence of the prerequisites specified in § 14 ThürAIKG or, in case of the authorization to submit building documents, in § 64 of the Thuringian Building Code, this opens the possibility for the foreign person to exercise the aforementioned services across borders in the Free State of Thuringia.

The Chamber of Engineers of Thuringia is the competent body for the Free State of Thuringia to verify the legality of the provision of services under the use of a protected professional title by foreign service providers and, if the legal requirements are met, to make the corresponding entry in the register of foreigners.

It should be noted that the external service provider must notify the Thuringian Chamber of Engineers in writing, enclosing the relevant evidence, even before the first provision of the aforementioned services, including the intended use of the legally protected professional title "Engineer", "Consulting Engineer".

A notification is only not required if the foreign service provider already has a valid certificate of a chamber of architects or engineers of another country corresponding to his field of expertise and informs the Chamber of Engineers accordingly.

In addition to the aforementioned notification, the external service provider must submit an application to the Thuringian Chamber of Engineers for the corresponding entry in the list of external service providers of the Thuringian Chamber of Engineers.

If the foreign service provider applies for the authorization to use the protected professional title "engineer", "consulting engineer" or the authorization to submit building documents, the Thuringian Chamber of Engineers will issue a certificate to the foreign person, provided that the requirements are met. This certificate is limited to one year in the case of an authorization to use the protected professional title "Engineer" or "Consulting Engineer" and, upon application, this period is to be extended by a further year in each case.

The registration in the list of foreigners kept by the Chamber of Engineers of Thuringia does not imply membership.
